These Terms of Use (“Terms”) govern access to and use of the AuthenticateIndia platform, website, mobile application, APIs, dashboards, onboarding systems, verification tools, and related services (collectively, the “Platform”) operated by Authenticate India Innovations Pvt Ltd or its affiliated entities (“AuthenticateIndia”, “Company”, “we”, “our”, “us”).

AuthenticateIndia is committed to privacy-first operations, lawful processing, information security, responsible technology governance, and industry best practices aligned with recognized standards including data protection principles, security controls, and management system disciplines.

By registering, accessing, or using the Platform, you acknowledge that you have read, understood, and agreed to these Terms.

Nature of Services

AuthenticateIndia provides technology-enabled trust, onboarding, verification, consent, workflow, and related digital services for individuals, businesses, agents, merchants, and authorized entities.

The Platform may facilitate:

• Identity onboarding processes
• Customer / merchant registration
• Consent capture workflows
• Video KYC workflows
• Verification request processing
• Audit trail creation
• Account administration
• Business enablement tools
• Referral / partner programs

AuthenticateIndia acts as a technology facilitator and does not guarantee the future conduct, solvency, legality, or intentions of any person or organization.

Eligibility

You may use the Platform only if:

• You are at least 18 years of age or legally competent to contract;
• You are authorized to act on behalf of any business entity you register;
• Information submitted by you is accurate and lawful;
• You use the Platform only for lawful and authorized purposes.

Registration & Onboarding Process

To maintain trust, compliance, and platform integrity, registration may include one or more of the following steps:

Individual Users

• Mobile number verification through OTP
• Identity verification workflows
• Name auto-population from validated source where applicable
• Email and city collection
• Video KYC
• Acceptance of Terms, Privacy Policy, and Security Policy
• Referral capture (optional)

Organization / Business Users

• Mobile number verification through OTP
• Authorized representative verification
• Business / organization verification workflows
• Name, email, city, business category collection
• Video KYC
• Acceptance of Terms, Privacy Policy, and Security Policy
• Referral capture (optional)

AuthenticateIndia reserves the right to request additional information, suspend onboarding, or reject accounts where risk, fraud indicators, incomplete information, or legal concerns arise.

Data Protection & Privacy Commitment

AuthenticateIndia follows a privacy-by-design approach and implements safeguards aligned with applicable law and recognized standards.

• Lawful, fair, and transparent processing
• Purpose limitation

• Accuracy where applicable
• Security and confidentiality

Stored Information

For legitimate operational, security, legal, and audit purposes, the Platform may securely store:

• Onboarding records
• Consent acknowledgements
• Account registration details
• Security logs
• Video KYC records (where applicable)
• Activity logs related to platform use
• Billing / support records

Important Clarification

Government-source verification data or fetched records are not intended to be persistently stored unless legally required, technically necessary for transaction completion, or expressly disclosed.

Security Controls

AuthenticateIndia employs reasonable technical and organizational controls, which may include:

• Encryption at rest and in transit
• Restricted administrative access
• Role-based permissions
• Logging and monitoring
• Tamper-resistant data controls
• Backup and recovery processes
• Incident response procedures
• Vendor risk governance

No digital environment can guarantee absolute security; however, we continuously strive to maintain appropriate safeguards.

User Responsibilities

You agree to:

• Provide accurate information
• Maintain confidentiality of OTPs, passwords, and credentials
• Use the Platform only for lawful purposes
• Obtain required consent before submitting third-party information
• Immediately report unauthorized access or suspicious activity

You shall not:

• Use the Platform for harassment, surveillance, discrimination, or unlawful profiling
• Attempt to bypass security controls
• Misrepresent identity or authority
• Reverse engineer systems
• Upload malicious software
• Use services in violation of law

Consent & Authorizations

By using the Platform, you confirm that:

• You voluntarily submit your information for onboarding and account creation;
• You authorize processing required to deliver services;
• Where you submit third-party information, you have lawful authority and required consent;
• Electronic consent records may be relied upon for compliance and audit purposes.

Verification Outputs & Reliance

Any verification status, match result, onboarding outcome, or response available through the Platform is informational and workflow-supportive in nature.

Such outputs:

• May depend on external systems or third parties
• May change over time
• May be delayed, unavailable, incomplete, or subject to source limitations

Users must apply independent judgment before making legal, commercial, employment, tenancy, lending, or risk decisions.

Retention & Audit Records

AuthenticateIndia may retain records for:

• Security purposes
• Fraud prevention
• Legal defense
• Regulatory obligations
• Contract enforcement
• Internal audits
• Service improvement

Retention periods may vary by data type, risk profile, legal requirements, or contractual obligations.

Account Suspension / Rejection

We may suspend, reject, restrict, or terminate any account if:

• False or misleading information is submitted
• Fraud or abuse is suspected
• Terms are violated
• Security risk is detected
• Legal or regulatory obligations require action
• Payment dues remain unpaid

Payments & Credits

Paid features may involve recharge credits, subscriptions, or usage-based billing.

Unless otherwise stated:

• Prices exclude taxes
• Promotional credits may expire
• Credits are non-cashable and non-transferable
• Charges may apply upon attempted or completed transactions depending on plan terms

Separate commercial terms may apply to enterprise users.

Intellectual Property

All Platform software, branding, systems, workflows, interfaces, documentation, trademarks, and proprietary materials belong to AuthenticateIndia or its licensors.

No ownership rights are transferred to users.

Confidentiality

Any non-public business, technical, pricing, security, or operational information shared by AuthenticateIndia shall be treated as confidential unless publicly available or legally required to be disclosed.

Limitation of Liability

To the fullest extent permitted by law, AuthenticateIndia shall not be liable for indirect, incidental, special, punitive, reputational, or consequential damages arising from Platform use.

Total liability, if any, shall not exceed the amount paid by the user to AuthenticateIndia in the preceding three (3) months relating to the relevant service.

Indemnity

You agree to indemnify and hold harmless AuthenticateIndia from claims, losses, liabilities, penalties, or expenses arising from:

• Your misuse of the Platform
• Unauthorized data submission
• Breach of law
• Violation of these Terms
• Misrepresentation by you

Compliance Statement

AuthenticateIndia endeavors to operate in alignment with applicable Indian legal requirements and recognized information security / management practices. Nothing in these Terms shall be construed as a waiver of statutory rights where applicable.

Amendments

We may revise these Terms from time to time. Updated Terms become effective upon publication on the Platform or notice to users.
Continued use after such an update constitutes acceptance.

Governing Law & Jurisdiction

These Terms shall be governed by the laws of India.

Subject to applicable law, courts at Vadodara, Gujarat, India shall have jurisdiction.
